Our Terms and Conditions

Starting a project is dependent on you accepting Community Spot Website Services' Terms and Conditions. These are listed below. They are subject to change so contact us for the current document or return to this page to check.

 

    1. Prices are based on you supplying all text and illustrations via the contact methods listed on the website.
    2. Completion times are subject to you supplying all required text and illustrations.
    3. Your project will start only upon receipt of these materials.

      Website Content

    4. It is your responsibility to ensure you are entitled to use, or have obtained permission to use, all submitted content.
    5. It is the customer's responsibility to maintain a backup copy to replace any content that might be lost.
    6. Use of our services is strictly subject to you, and any employees or agents, abiding by our Acceptable Use policy. This policy requires all content to comply with the following:
      1. It does not impinge on the intellectual property rights of any person or other entity
      2. Is not offensive, harmful, or objectionable and complies with any applicable law.
      3. Is factual and does not harm the reputation of any person or other entity.
    7. We accept you own the copyright to all submitted materials and to the website as a whole. Community Spot Website Services retains however the intellectual property and the right to reuse the various elements of the website. This includes, but is not limited to, layouts, templates, functions, graphics, fonts, software and documentation.

      Guarantees and Warranties

    8. Where a delivery time for your website is guaranteed, any reference to days is defined as working days, these being Mon to Fri inclusive.
    9. If your website has not been delivered by the time as guaranteed, you will be entitled to a discount on any fees payable as compensation.
    10. While we take all reasonable care, Community Spot Website Services does not accept any responsibility for errors, omissions, loss of profits, loss of data or other consequences from service failures.
    11. Your website carries a warranty that its features will function as intended for a period of 180 days from the date of invoice.
    12. This warranty does not extend to ensuring that your website is completely free from errors, is completely secure, or works on all browsers, operating systems or hardware.
    13. Any loss of functionality caused by changes, additions, or errors to the website by the owner is excluded from this warranty.
    14. In addition, it is agreed that Community Spot Website Services does not provide support for problems with services or hardware not provided by us. This includes your own computer and its software, your internet connection and phone line, and any other communication devices.
    15. Furthermore, if your website requires the use of products and services provided by another party, you agree Community Spot Website Services will have no liability in their provision. This includes, but is not limited to, payment functions, mailing services and hosting facilities.
    16. In addition to the warranty, you are entitled to support for the administration of your website. This support is to be provided by phone, internet and email. It is subject to a reasonable use limit of not more than one hour per month per account. You will be notified in advance of any additional charges.
    17. It is not possible to guarantee when or if your website will appear in the results pages of any search engines.
    18. You agree that services purchased for business purposes are not subject to the provisions of the Consumer Guarantees Act 1993.

      Payment

    19. Invoices are to be paid within 14 days of date of invoice.
    20. A service fee of 5% per month applies to all overdue accounts and any debt recovery costs will be added as required.
    21. If a job is cancelled by the customer once work has started, the work done until then will be invoiced on an hourly basis.

      Hosting

    22. Your Starter Website Package includes one domain name, hosting and email plan, inclusive of cost for one year. This expires at a date one year after first registration. You will be given fourteen days notice of expiry.
    23. Due to the need to submit your website to search engines, this hosting period commences from the start of the website development process.
    24. If you no longer require them, website hosting, email service(s) and domain registration(s) have to be cancelled in writing.
    25. It is your responsibility to purchase a hosting package to ensure your website remains on the internet. In the event of you failing to renew, your website files will be placed into a zip file and made available for download for fourteen days. This gives you the opportunity to change hosting providers if you so wish.
    26. Our spam protection system uses an image and encryption. It is effective, but cannot guarantee protection. Community Spot Website Services will not be responsible for any unwanted email.
    27. Backups are retained for a minimum of seven days. This gives your website the protection of being able to be restored if required. As part of your hosting plan, we are available to restore your website cost inclusive.
    28. It is your responsibility to notify us of any need to restore your website. Community Spot Website Services will take all reasonable care, but will not be responsible for any data loss.

      Privacy

    29. To carry out and improve our services, we may collect information about you. To enable this, you agree to the collection and storage of this information and its distribution to any support partners required to provide such services.
    30. For the promotion of both yourself and Community Spot Website Services, respective links may be included on our websites.
    31. From time to time, we may send you emails with information about ourselves and the services we provide. You can opt out of this by notifying us or by clicking the unsubscribe links contained within them.
    32. Both parties agree to keep all confidential information private, and to not disclose it to third parties unless required to do so by law. Such information is to only be used in relation to the provided website.
    33. You are required to keep all usernames and passwords supplied for the use of your website confidential.

      Termination

    34. If the Terms and Conditions are not met, you are liable to have the services provided by us terminated. You will be given 30 days written notice to remedy such breach. In the circumstance of termination, any outstanding amounts will remain due and the Terms and Conditions will continue to be in force.
